PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 14 January 1992 the applicant was apprehended by Ogden, Utah, civilian police and was pending disposition of charges for kidnapping. On 4 December 1992, Orders 205-1, DA HQ, 7 th Signal Command and Fort Ritchie; Fort Ritchie, MD, discharged the applicant from the Regular Army, effective date: 7 December 1992. The applicant was not available to sign his DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, AR 635-200, by reason of misconduct with a characterization of service of under other than honorable conditions (UOHC). Furthermore, the DD Form 214 shoes a Separation Code of JKQ (i.e., misconduct-commission of a serious offense). The specific facts and circumstances leading to the applicant’s discharged are not contained in the available records.

         b. On 7 December 1992, the applicant was discharged. At the time of discharge, the applicant had 4 years, 11 months, and 21 days, service on his current enlistment under review and 11 years, 4 months and 15 days, total time in service.

         c. The applicant’s DD Form 214 indicates that the applicant was an inmate at the Utah State Prison at the time of his discharge from the Army.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) The issue is rejected. The Army Discharge Review Board acknowledges the applicant's successful transition to civilian life and noted the accomplishments outlined in his application and/or in the documents with his application. However, in review of the applicant’s entire service record, the Board found that these accomplishments did not overcome the reason for discharge and characterization of service granted. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. The Board, being convinced that the reason of discharge and the characterization of service were both proper and equitable, voted to deny relief.
